Rental agreement

This agreement is between Baker Coastal Ventures LLC, as agent for the property owners (the Host), and the guest who books (the Guest), for 1235 Haven Avenue, Unit 2 (top floor), Ocean City, NJ 08226 (the Property). The Property is registered with the City of Ocean City under annual rental registration CECERT-26-04188.
1. This is a seasonal rental
- The Property is rented for vacation and seasonal use, for a term of not more than 125 consecutive days, to a Guest who keeps a permanent residence elsewhere.
- By booking, you confirm that you keep a permanent home somewhere else and that the Property will not be your residence. This agreement does not create a tenancy or a landlord-tenant relationship.
2. Reservation and occupancy
- The dates, rate, fees, and taxes are those stated in your booking confirmation, which is part of this agreement.
- Maximum 10 overnight guests, children included. Daytime visitors beyond that need our approval in advance, and the total on the Property may never exceed the listed capacity.
- The person booking must be at least 25, must stay for the whole reservation, and is responsible for everyone in the party. Before check-in you will give us the name of every adult in your party, the age of anyone under 25, and the number of children. The party at the house must match that list; we may refuse entry or end the stay, without refund, if it does not.
- No parties or events. This is a family rental in a two-unit residential building.
3. Check-in and checkout
- Check-in 4:00 pm, checkout 10:00 am, unless we confirm otherwise in writing.
- At checkout: set the thermostat to 73°, return the beach tags to the board, put trash and recycling in the outside bins, and follow the checkout list in the welcome book.
4. House rules
- Quiet hours 10:00 pm to 8:00 am. There is another family's home on the first floor. Noise complaints or an ordinance violation are grounds for ending the stay without refund.
- No smoking or vaping anywhere on the Property, inside or out.
- Pets: one dog, approved in advance, with a $100 pet fee per stay, waived on Dog Days weekend. No cats. Our insurer excludes certain breeds, so tell us the breed when you ask and we will confirm within the day. Unapproved animals are grounds for ending the stay without refund. Service animals are accommodated as required by law. Note that Ocean City bans dogs from the beach May 1 through September 30, and from the boardwalk year-round.
- Grilling: the provided gas grill, on the deck only. Unlock the front wheel and pull the grill clear of the railing before lighting it, then return it and lock the wheel once it has cooled. Never light it indoors or in the carport, never leave it unattended, shut the burners off when you finish, and do not store spare propane cylinders inside. No charcoal and no open flame anywhere on the Property.
- Parking: up to three vehicles in the assigned driveway spots only. The covered spot fits up to a mid-size SUV. We make no commitment about street parking.
- Beach tags: seven season tags are on the tag board. Lost or unreturned tags are $35 each.
- Ocean City is a dry town. The welcome book covers where to stop on the way in.
5. Payment
- If you booked through Vrbo, your payment, payment schedule, and any refund run through Vrbo on the terms shown when you booked, and any damage claim is made through Vrbo's process or by invoice; the rest of this agreement applies as written.
- Your booking is paid to Baker Coastal Ventures LLC, by card through our booking link or by another method we arrange with you directly.
- One schedule for every stay: 25% of the stay plus the cleaning fee is charged when we accept your booking, and the balance is charged to the same card 60 days before check-in. If you book inside 60 days, the full amount is charged when we accept. We send a reminder a week before the balance is due; keep your card current in your guest portal.
- If a balance payment fails and is not resolved within 7 days of its due date, the booking is cancelled on that day and the cancellation terms below apply as of that day.
- We will never ask you to send money to an individual. Payment always goes to Baker Coastal Ventures LLC. If anyone claiming to be us asks you to send money to a person rather than the company, it is not us. Call us at (609) 862-8010 before sending anything.
- A held week is priced at the published rate for that week in the year you stayed; discount codes do not apply to held weeks.
6. Cancellation
- Free for 24 hours after we accept your booking, as long as check-in is at least 7 days away.
- 60 or more days before check-in: full refund of everything you have paid.
- 30 to 59 days before check-in: 50% of the booking total is refunded.
- Inside 30 days: no refund. If we re-rent your dates, we refund what we recover, less our costs, at our discretion.
- Refunds go back to the card you paid with. We recommend travel insurance; storms, illness, and travel disruptions do not change these terms.
7. Damage
- Card hold: we may place a pre-authorization on the card on file for longer direct stays. If one applies to your booking we tell you the amount in writing before you pay, and it is released after checkout. It is not a charge unless there is documented damage under this section.
- You are responsible for damage beyond normal wear caused by your party or your visitors, and you authorize us to charge the card on file, or to invoice you, for documented damage, missing items, extra cleaning required by a breach of these terms, or unpaid fees, up to $1,500, after we send you an itemized description with photographs within 48 hours of checkout. Nothing here limits our right to recover a larger loss through other means.
- Tell us about damage before you leave. We handle honest accidents very differently from surprises.
- We may enter the Property with reasonable notice for repairs or safety, and without notice in an emergency.
8. Monitoring
The Property has a noise-level monitor that measures sound levels only and does not record audio or conversations, an exterior camera at the entry stairwell, and an exterior camera covering the carport and parking area. Both cameras face outdoor areas only. There are no cameras or recording devices inside the living areas, and none will be added during your stay.
9. Liability and general terms
- Use of the Property, including the exterior stairs, the deck, the grill, and the beach equipment, carries ordinary risks, and you and your party accept those ordinary risks. Nothing in this agreement limits our liability for our own negligence, or any liability that cannot be limited under New Jersey law.
- You agree to indemnify the Host and the owners against claims arising from the acts or omissions of your party, other than claims caused by our negligence.
- If the Property becomes uninhabitable before or during your stay, for example storm damage or utility failure, our liability is limited to refunding the unused nights.
- This agreement is governed by the laws of the State of New Jersey. You consent to signing electronically. If a New Jersey court finds any provision unenforceable, that provision is narrowed only as far as needed to make it enforceable in New Jersey, and the rest of the agreement stays in effect.
